This would be a federal crime. It would be a federal judge, no jury. And if there isn’t enough evidence the judge would dismiss it. Federal prosecutors tend to only accept a case they think they can win, their convictions rates are super high, near 100% because they only take slam dunk cases for the most part. If you don’t see them(Pam bondis office) pick up the case it’s because they no they can’t win and it would be dismissed immediately.

I've always heard of customers being 86'd from bars, meaning thrown out and not allowed back.

Our enemies are already doing it to us. Many patriots spent four years in federal prison without being charged because of January 6, 2021, they went to a capital building and took selfies inside. Calling the attack if the century, worst attack in the history of our country , a threat to our democracy etc etc

You're not wrong in the points you're making with respect to the concept of there should be something that separates us from them it's just that it's difficult to tell people "hey let's be careful with what we say and do our actions have consequences" when the side against you respects no such thing.
